			<content:encoded><![CDATA[<p>America is the land of opportunity and the home of capitalism. Today more than ever our country needs small business as the infrastructure of our economy. Do to the recession our nation has lost an estimated 10% of small businesses.  Two thirds of our nation’s economy is made up of small businesses. Our families and those who lived through the great depression pulled up their boot straps and became a part of an industrialized nation. They were inspired by innovation, and more than ever in our history, the people of this nation have a prerequisite in seeing the vision in achievement, not the difficulty of government standing in the way of progress.<span id="more-12"></span></p>
<p>Innovation is the key to companies who want to prosper. Innovation is also made up of intellectual property, trade secrets, and an edge over the competitor, whether national or foreign. Therefore, we need to expedite patent reform to allow for that innovation to be a tool for growth and expansion of small businesses in America today. The US Patent and Trademark Office (USPTO) needs to meet their obligation to process filed patents in a timely manner.</p>
<p>At the USPTO, once the original patent filing application search is completed and the examining group decides to reject the patent, the course of action is that it can be appealed. Should you win the appeal, the USPTO should issue the patent.</p>
<p>Instead, the USPTO initiates a new search, starting the process all over again, causing patent applicants to accrue attorney fees, and delaying the use and development of intellectual property. This has become a common practice among the examining groups at the USPTO and they are rewarded for doing it. This action has cost small businesses in this country millions of wasted dollars every year. The practice is stretching out pending patent applications for more than seven years.</p>
<p>“Small Business” should not be a talking point for politicians, but rather a call to action, restoring resourceful people to gainful employment, which our nation desperately needs.</p>
<p>Invest in small businesses and see how fast this economy turns around and the unemployment rate falls.</p>
<p><strong><span style="text-decoration: underline;">Please NOTE:</span></strong></p>
<p>The Under Secretary of Commerce for Intellectual Property and Director of USPTO David Kappos states:</p>
<p>“The Office is taking steps to deal with patent application backlogs, long waiting periods for patent review, outdated information technology systems that are regarded as outdated and an application process in need of reform.”</p>
<p>In the Director’s Forum David Kappos states:</p>
<p>“As you all know, reducing the backlog of unexamined patent applications and driving patent pendency down is our top priority.  This goal is especially urgent at a time when our economy is struggling, and the patent backlog is stalling the delivery of innovative goods and services to market while hindering economic growth and job creation.  It has been estimated that the current backlog of more than 700,000 applications may cost the U.S. economy billions of dollars due to what is called “foregone innovation”— commercial opportunities that fail to get off the ground because of long delays in obtaining necessary patent protection.  That is unacceptable and we are determined to turn things around because so much depends on it.”</p>
<p>The question remains, when will the issues at the USPTO get resolved, and why are they not making a more diligent effort when the unemployment rate stands at 9.5%?</p>
